Bank Freedom Privacy Policy

This agreement is effective as of May 27, 2008 and replaces any previous Privacy Policy for Bank Freedom.

Your Privacy.
At Bank Freedom we recognize that the trust of our customers is one of our most important assets. As such, our primary goal is to deliver innovative payment products and world-class service while ensuring the integrity and sanctity of our customer's privacy. The following outlines some of the steps that we take on a daily basis to ensure that our customer's information is secure, private, and used only in a manner consistent with our customers’ wishes. This privacy policy extends to all prepaid card services managed by Bank Freedom.

Safeguards we Take - We will safeguard, according to our standards of security and confidentiality, any and all information our customers share with us. Bank Freedom uses advanced security processes and technology designed to keep your information secure.  In particular, we have strict policies regarding information that is used by our employees and partners to ensure your information is kept secure.

Data Collected - We collect nonpublic personal information about you from the following sources: (i) Information we receive from you on applications or other forms, (ii) Information about your transactions with us, or others such as your account balance, transaction history, parties to transactions and Prepaid Card usage, and (iii) Information we received from third parties, including government agencies, consumer-reporting agencies such as your tax identification number and credit worthiness and credit history. We advise our customers about the general uses of the information we collect about them, and we will gladly and promptly provide additional explanation if our customers request it.

Access To Information – We will permit only authorized employees, who are properly trained in the appropriate handling of sensitive customer information, to have access to that information, and only if required by their business responsibilities. Employees who violate our Privacy Policy are subject to our disciplinary process, up to and including termination.

Opt Out - We give our customers choices as to how their information is used, if at all. We provide our customers with the opportunity to remove their names used for mail, telephone or online marketing upon initial customer contact and subsequently on an annual basis. This opt out choice includes products and services offered by Bank Freedom and our affiliate marketing partners, and customers may opt out by contacting us via U.S. mail at:

Disclosure - We may disclose aggregate information about our customers and former customers to third parties with whom we may have a marketing agreements, or those companies who perform marketing services on our behalf. This includes all information we may collect directly or indirectly from you.

Limited Release of information - Except as outlined in this Privacy Policy, we limit the release of customer information. In addition to providing our customers with the opportunity to opt out of marketing offers, we release information only with the customer's consent or request, or when we are required to do so by law or other regulatory authority. When a court order or subpoena requires us to release customer information, we notify the customer promptly in order to provide the customer with the opportunity to exercise their legal rights. The only exception to this policy is when we are prohibited from notifying the customer by law or due to a court order, or in cases in which fraud, money laundering and/or criminal or illegal activity is suspected.

Response and Explanation – We quickly respond to our customer's requests for explanation. In the event that we deny service or choose to end a customer's relationship, and to the extent permitted by applicable laws, we will provide a prompt and detailed explanation if requested.

Privacy Policy Changes – We will notify our customers in the event that our privacy policy changes. If our privacy policy is modified, we will attempt to notify our customers of these changes via email, U.S. mail or via telephone. Customers will continue to have a choice as to whether or not they allow us to use their information in this different manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our web sites (www.bankfreedom.com, www.payroll-card.com) notifying users of said change(s). In some cases where we post the notice we will also email users, who have opted to receive communications from us, notifying them of the changes in our privacy practices.

Consent – By providing my personal contact information and clicking 'Get Card Now', I give my express consent to receive marketing communications via direct mail, email, telephone, pre-recorded message, text message, and instant message from Bank Freedom. Cookies – Our website requires the use of cookies, pieces of information that a website places in a file associated with our customer's may be used to deliver content specific to their interests and for other purposes, such as security and other account administrative functions. For example, cookies are used to store customer preferences for certain types of information so that they do not have to input it every time they visit our site. Our cookies are encrypted and do not contain nor track personal identifying information; none will contain information that will enable anyone to contact our customers via telephone, e-mail or any other means.
Bank Freedom cannot control merchant sites use of cookies or be held responsible for those merchant's policies regarding the use of cookies.
We may collect "referrer" information, IP addresses, and various environmental variables.

  • Information the Web browser passes along to Web server that references the URL from which the customer came.

  • "IP address" is a number used by computers on the network to identify the customer's computer so that data can be transmitted to them.

  • "Environmental variables" include, among other things, the domain from which customers access the Internet, the time they accessed our Web site, type of Web browsers and operating system or platform used, the Internet address of the Web site they left to visit, the names of the pages they visit while at our Web site, and the Internet address of the Web site they subsequently visit.

This information is collected to enhance web site security and to detect broad member trends.

Security – The Bank Freedom website has security measures in place to protect the loss, misuse and alteration of the information under its control. All personal and account activity information collected on and used by the www.bankfreedom.com www.payroll-card.com and other supported customer service web sites are not accessible by the public or via the Internet. All accesses to our databases wherein personal information are kept are logged for security purposes and access is limited to key personnel. All personal information, account activity and purchasing activities are protected via user names and passwords. All user-specific activities (those that are accessed during and after a user logs-in with their user name and password) are protected using a secure communications encryption technology called SSL.
SSL (Secure Socket Layer) is a security feature that creates an encrypted connection between the client (your computer) and our server (www.BankFreedomCard.net), which prevents the interception and inappropriate use of this critical data. Transactions through a server using SSL are far safer than using a credit card at other retail establishments. It is much easier for credit card thieves to sift through trashcans at banks or retailers than to harness the genius and super computing power necessary to decrypt the small bits of secure data transmitted during an SSL connection. The point is that our customer's greatest risk for exposure of personal or financial information and transactions is NOT the use of properly secured sites such as www.Bank FreedomCard.com, but rather from information made available by their everyday activities.

MetaBank™ Privacy Disclosure

This agreement is effective as of November 05, 2008 and replaces any previous Privacy Policy for MetaBank™.

This Privacy Disclosure explains the privacy policies of MetaBank™ and Bank Freedom ("Company") with respect to the Bank Freedom Prepaid MasterCard® Card prepaid card program. We are committed to protecting our customers' privacy and security. This disclosure explains what information we collect about you, with whom we share it, and how you can direct us not to share certain information with certain parties.

DEFINITIONS

We, our, and us, means MetaBank™ and Company, the marketer for your Bank Freedom Prepaid MasterCard card issued by MetaBank™.

You and your, means customers with a Bank Freedom Prepaid MasterCard card issued by MetaBank™, as well as any consumers who enroll for a Bank Freedom Prepaid MasterCard card issued by MetaBank™.

Nonpublic personal information, means information about you that we collect in connection with providing a financial product or service to you. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records. Hereafter we will use the term "information" to mean nonpublic personal information as defined by this section.

Affiliate, means a company MetaBank™ or Company owns or controls, a company that owns or controls MetaBank™ or Company, or a company that is owned or controlled by the same company that owns or controls MetaBank™ or Company. Ownership does not mean complete ownership, but means enough to have control.

Nonaffiliated third party, means a person not employed by MetaBank™ or Company or a company that is not an affiliate of MetaBank™ or Company.

Opt out, means a choice you can make to prevent certain sharing or use of information. We will explain how you can exercise this choice.

INFORMATION WE COLLECT AND DISCLOSE

We collect and may disclose the following information about you:

o Information you provide on applications or other forms, such as name, address, e-mail address, social security number, telephone number, and date of birth;
o Information about your transactions with us, our affiliates, or other parties, such as card balance, payment history, parties to transactions, and card usage; and
o Information we receive from a consumer reporting agency, such as verification of your identity and creditworthiness.

We may also collect and disclose information about how users use our Web site, for example, by tracking unique views received by pages of the Web site or the domains from which users originate. This information is not personally identifiable. We may also use "cookies" to track returning users to our Web site. A cookie is a piece of software that a Web server can store on the users' PCs and use to identify the users should they visit the Web site again. Information collected may be associated with nonpublic personal information users provide us through our Web site.

INFORMATION WE SHARE WITH SERVICE PROVIDERS OR JOINT MARKETERS

We may disclose all of the information we collect, as described above, to companies (including affiliates) that perform services on our behalf, including those who assist us in preparing and mailing statements (if applicable) and responding to customer inquiries. We may provide that information, except for information from consumer reporting agencies, to others who perform marketing services for us and to financial institutions that are not our affiliates with whom we jointly offer financial products or services. You do not have the right to opt out of the disclosure of this information.

INFORMATION WE SHARE WITH AFFILIATES

Our respective affiliates include nonfinancial companies, and may include financial service providers, such as insurance companies. In addition to the information we share with affiliates that provide services to us, we may share information described above among our respective affiliates in order to provide you with information about additional products and services. You have the choice to opt out from our sharing of information with affiliates although, even if you opt out, we may still disclose your information as permitted by law.

INFORMATION WE SHARE WITH NONAFFILIATED THIRD PARTIES

We may disclose information to third parties who do not belong to our corporate family. These nonaffiliated third parties may include financial services providers, such as mortgage and insurance companies; nonfinancial companies, such as direct marketers, retailers and publishers; and others, such as nonprofit organizations. You have the choice to opt out from our sharing of information with these types of third parties although we may still disclose your information as permitted by law. In addition, we generally will not disclose information to nonaffiliated third parties as long as your billing address is in California or Vermont except as permitted by law.

INFORMATION ABOUT FORMER CUSTOMERS

The privacy policies and practices described in this Privacy Disclosure also apply to our former customers.

PRIVACY PRACTICES OF THIRD PARTIES

Our website may feature links to third-party sites that offer goods, services, or information. We are not responsible for content or privacy policies or practices of any advertisers or linked sites of any third parties. We encourage you to review their privacy policy before providing them with any personally identifiable information. Third party sites may collect and use information about you in a way that is different from this policy.

ACCESS OR CORRECT YOUR INFORMATION

CHANGES TO THIS PRIVACY DISCLOSURE

We may change our Privacy Disclosure from time to time. We will provide current customers with a revised disclosure that describes the new practices as required by law.

SPECIAL NOTICE FOR CALIFORNIA RESIDENTS

In order to comply with California law, if our records with respect to your card indicate a California address we will not disclose information that we have about you outside of our family of companies, unless otherwise permitted by law.

SPECIAL NOTICE FOR VERMONT RESIDENTS

In order to comply with Vermont law, if our records with respect to your card indicate a Vermont address we will not disclose nonpublic personal financial information about you to nonaffiliated third parties, other than permitted by law, unless you authorize us to make that disclosure. Your authorization must be in writing or, if you agree, in electronic form. If we disclose information about you to nonaffiliated third parties with whom we have joint marketing agreements, we will only share information about your name, contact information, and our own transactions and experiences with you.
